Can my curfew terms be changed??

16th Apr 2018

I have just started serving a suspended sentence for gbh alongside comunity service and a big fine is a 3 month curfew. The curfew is quite relaxed 10pm-6am however I work as a plumber and emergency call out work can be a problem with this. I have heard the probation guys can refer me to the courts who can decide to take me off curfew and probably give another punishment instead. Is this possible?

A sentence can be varied on your application.  Probation can bring it back to court, but you can bring it to court yourself and ask that the sentence be changed.  If the court knew about the out of hours work that you did when passing sentence then it might be unlikely that the order is changed.  If this is a development in your career since you were sentenced then the court might agree to vary the sentence - you'd need to support the application with some evidence that you would be called out regularly if the curfew were removed.  Each case will be dealt with on its own facts so perhaps you should contact the solicitor that represented you at court?
