Difference between PR and ILR

19th Oct 2018

Good morning, I have a Permanent Residence document and I'm uncertain as to whether I need to apply for settled status.  The Home Office appears to make a distinction between ILR and PR as follows:

  • You will not need to apply if you have indefinite leave to remain in the UK; but further says:
  • It’ll be free to apply if you have a valid permanent residence document

Many thanks for any clarification you can offer.

    Dear Sir/madam

If you have permanent residency in the UK, this will no longer be valid after 31st December 2020, and therefore you should look to apply for settled status. You will not have to pay for this or prove that you have 5 years continuous residency in the UK.

If you have Indefinite leave to remain you can remain in the UK without applying for settled status or you can choose to change your it to settled status.

You will be able to apply after the scheme open in March 2019 and we at Shawstone Associates can assist with this. You can contact us on 0208 538 0114 or alternatively visit our website at www.shawstoneassociates.com to arrange a suitable appointment.

    Thank you for your enquiry.

If you currently hold permanent residence in the UK, you can apply for settled status from 30 March 2019. However, please be aware that the deadline for applying for settled status is 30 June 2021.  The application is free if you currently hold permanent residence and you will not need to demonstrate that you have lived in the UK for 5 years.

Settled status does not apply to those who hold indefinite leave to remain as this is under the immigration rules and relates to non-eea nationals.
