To change an address that an electronic tag is registered to, you need to contact the court ,the probation and the Tagging company to get the matter listed so that the court can determine whether the new address is suitable. If you move address without informing the court, probation or the Tagging company it may be a breach of conditions and that may attrach either a breach or reversal of the bail conditions

How can I change the address that an electronic tag is registered to? 

You can apply to the Crown Court that imposed the original order to either vary or discharge the order. I note that your order is very old and pre-dates some important case law. Most notable of these cases was R v Smith & others 2011. As a result of this case, disproportionate orders, for instance, those banning all use of the internet, were found to be unlawful. The same with conditions that duplicated the terms of the notification requirements. If your order isn't 'Smith' compliant, it may be easier than you think to get it either varied or discharged. I would recommend that you find a solicitor locally who can have a look at your 'order' and advise on the prospects of either having it discharged or perhaps varied.

How can you discharge a SOPO? 

Hello, great question! Essentially, a 16 year old would not need legal representation, however, they will need an adult to accompany them in legal proceedings. That said, it would be wise to seek legal advice anyway and get some representation should charges be pressed.

Lying in court is a criminal offence known as perjury. It can be punihsed by up to two years in prison.

If you are concerned that a witness has lied in court then you should report the matter to the police for them to investigate.

If a witness has lied in court and that has affected your own case (e.g. if you have been convicted in a criminal case or you have had an adverse outcome in a civil matter) then you should mention this to the lawyers who represented you. They may be able to help you with an appeal in some circumstances.

What action can I take if I can show witnesses lied in court?

Assuming that the 'family member' that he was convicted of assaulting wasn't a child, then it is unlikely that social services will seek to get involved.

You do not mention whether the Suspended Sentence Order was conditional or with conditions. Either way, the operational period of the Suspended Sentence Order is 2 years from the date on which you were sentenced in April 2017. As I hope was explained to you at the time by your legal representative, breach of the Order, either by way of conviction for a criminal offence during the 2 year operational period or by not keeping to the terms of the Order, could result in the suspended 12 month term of imprisonment being activated in whole or in part, unless it was not in the interests of justice for that prison term to be activated.

In short, if your Offender Manager at the National Probation Service wishes to see you at any time during the two year operational period then it is in your interests to keep to that requirement in order to avoid the risk of being breached and being returned to Court for Committal for Breach.

You are correct in assuming that the operational period of the Suspended Sentence Order runs for 2 years from April 2017 until the second anniversary of your sentencing date in April 2019.

TheChild Sex Offender Disclosure Scheme [https://www.gov.uk/find-out-if-a-person-has-a-record-for-child-sexual-offences]allows requests to be made to the Police for disclosure whether someone has a criminal record for child sexual offences. The scheme is for any member of the public who wants to find out if an individual in contact with a child has a record of child sexual offences.



If Police checks show the individual has a record for child sexual offences, or other offences that might put the child at risk, the Police will consider sharing this information. The Police will only consider telling the person best placed to protect the child (usually a parent, carer or guardian) if the person being checked has a record of child sexual offences, or other offences that indicate they may pose a risk to a child. The Police can only disclose information if it is lawful, necessary and proportionate to do so in the interests of protecting the child(ren) from harm.



An application can be put in person at a local police station or by calling 101. There is generally no set format for the application. To make a request for information, it tends simply to involve a visit your local police station, where you can express your concerns. An officer or member of staff will take the time to gather all the necessary details and discuss the next steps with you.



After the application is submitted, the Police will assess if the person named in the application is a threat to children based on previous child sex abuse convictions. If, on checking, it is deemed necessary to protect the child(ren) by disclosing material information (for example, because the person has convictions for sexual offences against children, or poses a risk of causing harm to the child(ren) concerned) then this information will be given to the those who are the immediate care givers for the child. 



Checks should be completed to ensure that there is no immediate risk of harm to the child(ren) within 24 hours of the report.



The person being checked will not be told that they are being risk assessed unless a disclosure subsequently takes place as a result. If a disclosure does take place the person may be informed that someone is going to receive a disclosure about them.

If you believe that the solicitor has acted fraudulently, as with any other crime, contact the police. This seems to be what you are alleging.

If it were simply a case of over-charging, then the Legal Services Ombudsman may assist. A complaint can be made online. Their website is http://www.legalombudsman.org.uk. You should however make your initial complaint to the firm of solciitors involved. It is a requirement that they have a complaints handling procedure in place.

Who do you report a rogue solicitor to?

As you are being interviewed under caution you will be able to obtain free representation (not means tested) from a local solicitor. You should contact a local firm who holds a legal aid contract and they will be able to assist you. You should not be interviewed by the police without being represented (whatever the police may say!)

Unfortunately deposititng 'trade waste' in a recipticle intended for domestic recycling does indeed amount to the offence quoted. It seems very petty but increasingly councils are checking to make sure that commercial premises have contracts for the disposal of their waste. Actions against the police for failing to record a report regarding an assault on my daughter who was a minor when this happened

She will be entitled to apply for legal aid and she will pass the means test due to lack of income, but the solicitor you instruct will know the wording to use to satisfy the Legal Aid Agency due to her circumstances. This doesn't appear to be an assault that would fall into the most serious sentencing band, but it may be that she could receive a community order. Her age and lack of convictions and admissions in interview that demonstrate remorse may well mean there could be an argument for a fine. She ought to see a solicitor, or at the very least ask for the duty solicitor at court to check that it is appropriate for her to plead guilty and if so put mitigation on her behalf.

Sentence for assaulting a police officer

Unfortunately criminal cases are often one person's word against another although there is usually something to corroborate the case - here it could be a record of the phone call being made or evidence of an existing grudge or other behaviour previously directed at the complainant.

If your friend denies the call was ever made then the complainant's record of incoming calls will be important, particularly if the complainant claims to identify your friend's phone number or voice?

So, perhaps it isn't the strongest case, but the prosecution could still proceed. I'm sure that his legal team are on it.

I am assuming that in addition to being subject of the notification requirements, your son was also made the subject of a Sexual Harm Prevention Order. These orders are tailored to the individual offender and without having sight of the conditions attached to his particular order, it is not possible to say whether opening a bank account was in breach of those conditions.
