When employers need to reduce the size of their workforce, they may be forced to make people redundant, which is a form of dismissal. There are a variety of considerations that employers must make when faced with making redundancies to ensure that they act in a legal and fair way.

If your job no longer exists or the need for your skills is no longer apparent, the employer make be authorised to make your job redundant. This may involve offering you a position elsewhere in the company, or offering you redundancy pay as a form of compensation, providing you have worked for the company for long enough to warrant such a benefit.

A company may also be forced into making redundancies if the workload is not as expected or the industry that you work in suffers a lack of custom, investment, sources or interest. This may result in short-term lay-offs, where business is expected to improve again, or it may mean that a business has to cease trading, in which instant, all employees will be redundant.

It is illegal for an employer to discriminate against employees when making redundancies. That is to say that an employee cannot be made redundant for factors such as age, gender, religion or disability. The selection must be made based on business needs, skills and other fair methods.
