What is Gross Misconduct?

Good afternoon.

Your employer needs to carry out a sufficient investigation into your alleged misconduct. Ordinarily, this would mean that you should firstly attend an investigation meeting.

At either, or both, of the investigation and disciplinary hearing/s you should clearly state your version of events and explain why the statements are untrue. If you can, you should also provide any evidence which disputes what has been said by them. This could include any emails, documents or other witnesses.

Disciplinary hearing - What are my rights?

Sorry to hear about your situation. It obviously sounds like you have been treated unfairly. However, whether you are able to do anything about your dismissal would depend upon your length of service. Ordinarily, employees need more than 2 years' service before they can advance an unfair dismissal claim. Unfortunately, if you have less than 2 years' service, then all you would normally be entitled to is your notice pay. I hope this in some way assists.
