Can my daughter in law make a claim on assets I own with her husband (my son)

Posted on 5 Jun 2020

I own a house jointly with my son as tenants in common. Split is 70/30 in my favour. I don't live in the house, but in another I own.  I pay all the mortgage on the jointly owned house via a standing order to my son who then pays the bank.

My son is married and lives in the jointly owned house with his wife. They have a young child and are about to split. This house was bought after they got married.

There is about £80k equity in the house.

Can my daughter in law make a claim on my 70% of the equity and can I claim the 30% of the mortgage they've never paid?
