Can my partners daughter choose to live with us?

My partner has 2 children from a previous marriage; one of whom resides with us. The daughter aged 9 who resides with her mother has asked to live with us. 

We have asked reasons for this and she says that she prefers her own room at ours, shes not happy at home and doesn't get on at school. We have discussed this with the mother and have suggested having the daughter on a trial whilst maintaining her normal school routines and extra curricular activities. The mother doesnt seem keen on this idea. 

We dont know if it is worth pursuing this legally as not sure if the daughter would be Gillick competent. Can you help?
