The starting point when dividing the matrimonial assets is an equal division. However, that is only a starting point. The Court would also consider things like both parties needs (clearly revevant in your case) and conduct of one party can also be taken into consideration. In England & Wales (I am unsure of the position under Scottish law) there is no financial limits on who can enter into a Pre-nuptial Agreement.
