How do I go about arranging a Power Of Attorney?

Hi there,

The ownership of a vehicle is something which can be argued regardless of who is named on the V5 document. The registration document confirms at the top of the document that it is not proof of ownership and that the person named is the registered keeper and responsible for taxing, insuring and the MOT on the vehicle.

The registered keeper should usually be the person who is actually using / keeping the vehicle but not necessarily the owner of the vehicle or the person who is paying for it. The owner could be the person who put up the cash for the vehicle, or if the car is leased or a company car, the owner will be the company.

The registered keeper is the person responsible for parking tickets etc, and when you think about it, that’s why a lease company would want the driver to be the registered keeper, even though they own the vehicle.

Where the vehicle has been given as a gift, it is arguable either way but the presumption will be that it belongs to her. If you are married the ownership of property is usually classed as joint. If you are not, then the person who received the gift would usually be the owner, but it would depend on the particular circumstances. It may depend for example on who has paid for ongoing repairs, insurance, road tax and any finance payments. If that has been you, then you may have a claim for all or part of the vehicle in equity.
