The time will run from the date you can be considered to have been a qualified person and were resident in the UK. This will differ depending on your circumstances. Although the time would certainly run from the date of issue of your resident card it could be earlier and in most cases will be. In order to confirm the exact date I would need to have additional information but it will be somewhere between the date of you entering the UK and the date your resident card was issued.

Permanent residency

First of all if you have any concerns about your immigration adviser you should check that they are regulated. Solicitors can be checked by confirming the SRA registration number of the firm and solicitor and a quick way to do this is to go to the Find a Solicitor service on the Law Society Website.

Where the advisor is not a Solicitor they should be regulated by the appropriate profession body. Usually this will be the OISC and you can confirm their status wtih a regulator.

It is not unusual for disbursements (payments for things other than your legal fees) to be paid on your behalf. However, you should also be given the opportunity to make the payment directly for Home Office fees particularly as this can be done online by card.

Child overstay on 6 month visa but I have indefinite leave to remain. Will I be able to apply for him to get ILR ?

From the information you have provided , you may be able to undertake freelance jobs as long as it is: in either a job which is included on the Shortage Occupation List in Appendix K of the Immigration Rules, or a job in the same profession, and at the same professional level, as the work for which your Certificate of Sponsorship was assigned; and no more than 20 hours per week; and outside of the normal working hours for which your Certificate of Sponsorship was assigned. In addition, you must continue to work for your sponsor in the job recorded on your Certificate of Sponsorship.

Can I take freelance jobs from online sources like fiverr as I am on a tier 2 MoR visa which states I can't take up a second job?

A: 'Your civil claim does not necessarily help your visa application ( you did not state the basis of your FLR application or the current visa you hold).If the claim has nothing to do with your FLR application, then it is advisable not to mention it)

Q: I have also made Home Office as the second party in my writ petition which I an planning to submit soon. Is that a good idea?

I am afraid the Home Office may react to it negatively so I shouldn't mention them at all in the writ. However, I m also thinking the initial receipt produced by the Sheriff's court and the judge's initial standard order may assist'.

A: Your FLR application will be treated on its own merit. Your civil claim will not have any impact on their decision, whether positive or negative.

Q: 'In your perspective, is the Home Office going to give the above any credence or should I not mention them at all in the initial writ?'

A: Unfortunately, I am unable to answer this question because I do not know why the Home Office is being included in the first place.

A court hearing against my current visa sponsor. How is the UKVI going to consider this if I mention it in my FLR application?

Marriage visitor visa cannot be extended within the UK. Given that you have already applied for ILR it will be difficult fo you to sponsor your wife on spouse settlement visa until you get decision on your outstanding application.
