Any claim would be brought under the Occupiers Liability Act. This states that the owner of the premises needs to take such steps as are reasonable to ensure your reasonable safety. It is not an absolute duty and the fact that the accident occurred does not automatically make them liable.



Further information would be required with regard to the location of the tile surface. If it was in a dining area then there is a greater onus on those with supervision to ensure that the floor is dry than if the incident occurred by the side of a swimming pool.

I slipped whilst at Center Parcs because of very slippery floor tile surface. I was only walking slowly when fall occurred. Broken wrist!

How can I claim for injury I have sustained when a bus braked to avoid an accident; when the bus company is not at fault? 

It is very difficutl to give correct advice without knowing more about the circumstances of the fall and without investigating further. Ultimately, the council are required to inspect and maintain roads and pathways however the facct that you have fallen and suffered injury isn't in itself enough to guarentee a successful claim.

The frequency in which the council are required to inspect the area will depend on the type of road and their policies. If they are complying with their own policies by regualrly inspecting the area and the defect was not present during their last inspection then your claim is unlikley to be successful as the council are not expected to fix every defect as soon as it arises. If however the inspections haven't been carried out as per the council's policies, the defect is not deemed dangerous (usually less than an inch in height) or they had been made aware of the defect prior to your accident but not taken any action then the prospects of success of your claim increase.

As a starting point, I would recommend that you take photographs of the defect including measurements of the width, height and depth as soon as possible. From there any solicitor who is instructed can consider given more details advice based on the prospects of success.

How do I claim compensation for domestic violence which left me with life long back injuries?

You don't have to write a letter of complaint before starting a claim but I generally advise my clients to do so. The reason behind this is that the response provided by the hospital to your letter of complaint can help your solicitor to assess the extent of the claim and any potential defence which the hospital wishes to submit.

I appreciate that this often means more work on your part but I just feel that it gives the claim in general a better chance of succeeding.

Should I write a letter of complaint to the hospital before making a claim for clinical negligence?

Personal injury claims must be settled or alternatively court proceedings must have been issued on the claim within a period of three years from the date of the accident/injury. In some circumstances the three-year limitation period can run from the date of knowledge i.e. the date that you became aware that you had suffered injury as a result of the incident.

I suspect from the information you have given that you were aware that you had suffered an injury the moment the generator exploded and therefore it is most like that your three years will run from the date of the explosion.

If the incident happened after October 2015, you may still have time to lodge a claim. If the three-year time limit is up any time between now and then you may struggle to find a firm to take on the claim due to the vast amount of work needed to protect the claim within a very short period of time.

Unfortunately, if the incident occurred before 20th August 2015 then you have most likely already missed the limitation date. An application can be made to the court to get around this but you would need to provide a very good reason for why the date has been missed. It would not be sufficient to say that you weren't aware of the time limit to make a claim. Any solicitor instructed to make such an application is likely to need paying on an hourly rate as the costs of that work are unlikely to be recoverable even if the application is successful.

Time frame for claiming a personal injury

I've dealt with a similar matter in the past and struggled to get a barrister on board.

The case will ultimately hinge on two things:-

1. Whose land the public footpath was crossing so it can be determined who was responsible for it's upkeep and whether they have been regularly maintaining the stile.

2. Whether it was obvious that the stile posts were rotten without stepping on it.

If it wasn't obvious that the stile posts were rotten from looking at them, the person or organisation responsible for the upkeep of the stile will have a good chance of defending the claim as they would not be expected to spot defects that were either hidden or disguised.

Injury Caused by rotten Stile crossing on public footpath

I'm sorry to hear of your ordeal and the confusion over the claims process.

There is a government scheme known as the Criminal Injuries Compensation Authority which compensates victims who have been injured as a result of criminla activity. Usually the time limit for bringing a claim is two years however in cases such as that you have described there is often some level of leniency.

You can instruct a solicitor to deal with this type of claim however as the CICA doesn't make a payment for legal fees you will find that firms usually need to take a % of your compensation at the end of a successful claim. You can however start and run the claim yourself which will enable you to recover the full compensation award.

Can I claim compensation?

I will assume that as you have made reference to euros that the incident occurred outside of the uk?

If you were on a package holiday e.g flight and hotel were a combined unit then you will have the benefit of the ABTA regulations which allows you to bring a claim against the holiday company presumably booked/based in the UK which makes matters easier than going against an individual hotel in another country.

The level of responsbility and the duty of care owed to you is that of the standards local to that area but I would suggest that cleaining up spillage is expexcted in all hotels. The difficuluty would lie in proving the spillage.
