How do I find out where my mum made her will?

If there is no Will your sisters estate will need to be controlled by the Court of Protection who will decide who receives the assets. You would be strongly advised to consult a Solicitor to assist you

You need to establish if the POA is for Financial affairs as opposed to Health, it must be registered with the office of public guardian and you need to see if you need to act jointly with your sister or whether you can act ‘severely‘ I.e. on your own. If it is joint both you and your sister will need to act on the sale

I have PoA for my Mum who is in a care home.

The family member is intestate ie had no Will so the Court will decide who inherits and they will appoint the trustees if there is a trust for the underaged children. there will need to be at least 2 trustees

Technically no. On death, the Executor will have custody of any remains and are responsible for funeral arrangements. They are not required to follow any wishes expressed in the will although it would be unusual for them not to. In practice, the funeral is normally arranged by someone who accepts the task. If you think your executor may not follow your wishes you may want to think about making your wishes known to other family or friends s who could endeavour to carry them out.

Firstly,you can get the proof of payment from the bank as they will keep all the required records.

As for the Wills and your sister, without seeing the detail of those documents it is very difficult to make a judgement. If they leave the money to your sister you are bound to pay it over. If they stated that a trust should be set up with you as trustee then it will be at your discretion when payments are made bearing in mind that everything must be to the benefit of your sister's welfare.

If you are the only relative, this would have to be proved, you will be entitled to all of the estate of the deceased. You would in any case need to apply for probate/letters of administration in the UK to become the executor and as such you would be entitled to any genuine out of pocket expenses from the estate assuming the estate has enough assets to cover them. My deceased father's cousin has passed away with no will and no relatives with the exception of me. 

Assuming your mother was legally married to you father, if he dies intestate (without a will), then everything will pass to your mother regardless of whether or not she is named on any assets.

You can amend your will, however this will need to be done by way of a codicil. If you want to have it as a new will, then you must ensure all requirements of having a valid will, for example how it is witnesses, are met.

It depends.

If the house was owned as Joint Tenants by her father and his wife then she would have inherited under the right of survivorship and then could pass the property from her estate to whoever she wanted.

If the house was solely owned by her father, or was owned as Tenants in Common then she may well be entitled to some or all of the property, depending on whether her father left a Will or died intestate (without a Will).

My father passed away in 2002. I have just discovered that the deeds to the property have now been 

 1. With regards to the property being left to her children if she dies, this would need to be put into a will
 2. With regards to the property being left in each other’s name should the marriage fail, this could potentially be put into a pre-nuptial agreement but there are issues as to whether these can be enforced

I am about to re marry. My future wife wants her property to remain in her ownership to be left to her children if she dies and I do too.

The problem with having a will drawn up by a retired solicitor is that they will almost certainly not have the professional indemnity cover i.e insurance that all practicing solicitors are required to have. If anything goes wrong or there is an error in the drafting of the will then you will have trouble making recovery of any losses. Best to pay the extra and go to a practicing solicitor.
