It is possible for parents to make child maintenance arrangements privately, through government schemes or, in complex situations, through a court order. Both parents have a legal obligation to financially support their child and if they separate, the main day-to-day caregiver of the child will normally receive financial payments from the parent who is not responsible for the prime caregiving.
  • Parental Responsibility - All mothers and most fathers automatically receive parental responsibility on the birth of their child which gives them legal rights and responsibilities. Those who have parental responsibility have the following legal duties: To provide a home and protect and maintain the child and their belongings, disciplining the child, establishing education for the child and agreeing to any required medical treatment that they need. Even if a parent does not have parental responsibility, they are legally obliged to financially support their children.
  • Prohibitive Steps Order - Parents can be prevented from carrying out certain acts when a court grants a Prohibited Steps Order (PSO). This includes prohibiting specific trips with a child without having received prior consent from the other parent. A PSO is often granted when there is a concern that one parent may leave the area with their child.
