The term custody is often referred to as residency which reflects the need to establish a child’s main residence following a parental breakup. Children can equally divide their time between both parents if joint custody can be established. Joint custody also allows for both parents to make decisions affecting the child. A court order will be required if parents are not able to amicably make decisions regarding their children following a break-up.
  • Child Maintenance - Child maintenance helps support the everyday living costs of a child and usually takes the form of regular payments. Parents are able to arrange child maintenance payments privately, through a government scheme or in complex situations, through a court order. There is a legal duty for both parents to financially support their child as it is being raised and if the parents separate, the parent who is not responsible for the normal day-to-day care of the child usually pays money to the other parent to support the upbringing.
