What type of issue can a child law solicitors in Alcester help me to remedy?

The types of cases which involve aspects of child law are massively varied, and might include both criminal and civil law. Child law solicitors located in Alcester can offer you expert legal advice on a variety of complicated problems. Some of the more popular areas of support includes the following:

  • Child Custody - Child custody laws establish who is responsible for the care and maintenance of a child following the breakup or separation of a parental relationship. The term residency is regularly used in the same way as custody to reflect the law’s need to establish the main residency of a child following the separation of their parents. Joint custody is possible and this enables the child to divide their time equally between each parent. In joint custody arrangements, both parents are able to make decisions affecting their child. A court order will be required if parents are not able to amicably make decisions regarding their children following a break-up.
  • Parental Responsibility - All mothers and most fathers automatically receive legal rights and responsibilities as a parent, and this is known as ‘parental responsibility’. Parental responsibility means that the parent has the following duties: To provide a home and protect and maintain the child and their belongings, disciplining the child, establishing education for the child and agreeing to any required medical treatment that they need. Even if a parent does not have parental responsibility, they are legally obliged to financially support their children.
  • Child Maintenance - Child maintenance usually takes the form of regular payments and is used to support the financial costs of raising a child. It is possible for parents to make child maintenance arrangements privately, through government schemes or, in complex situations, through a court order. Both parents have a legal obligation to financially support their child and if they separate, the main day-to-day caregiver of the child will normally receive financial payments from the parent who is not responsible for the prime caregiving.
  • Prohibitive Steps Order - Parents can be prevented from carrying out certain acts when a court grants a Prohibited Steps Order (PSO). This includes making specific trips with their children without having the prior consent of the other parent. A PSO is often used when there is a suspicion or threat that one parent may leave the country with their children.
  • Adoption - Children who cannot be raised by their birth parents may be adopted, and this means that they can join a new and permanent family. To be adopted, a child must be under the age of 18 and not be married or in a civil partnership. Consent from the birth parents is normally required for the adoption to go ahead, unless they cannot be found, they are incapable of giving consent or their consent is deemed as an unsafe pursuit for the child.
