What services do Dudley children law solicitors provide?

The types of cases that could involve aspects of children law are hugely varied, and include both civil and criminal law. Children law solicitors located in Dudley should be able to offer specialist legal services on a number of challenging issues. A number of the most frequent areas of assistance include:

  • Child Maintenance - Child maintenance helps support the everyday living costs of a child and usually takes the form of regular payments. Parents are able to arrange child maintenance payments privately, through a government scheme or in complex situations, through a court order. There is a legal duty for both parents to financially support their child as it is being raised and if the parents separate, the parent who is not responsible for the normal day-to-day care of the child usually pays money to the other parent to support the upbringing.
  • Prohibitive Steps Order - A Prohibited Steps Order (PSO) is an order that is granted by the court and serves to prevent either parent from certain actions. Such acts include taking specific trips with a child without the agreement from the other parent. A PSO is usually granted when there is the concern that one parent may attempt to leave the country with their child.
  • Child Custody - Following the separation or break-up of parents, child custody laws establish who will be responsible for the care and charge of a child. The term custody is often referred to as residency which reflects the need to establish a child’s main residence following a parental breakup. In joint custody arrangements, a child is able to equally divide their time between both parents. Joint custody arrangements allow for both parents to make decisions which affect their child. If parents cannot make amicable decisions regarding their child following a break-up, a court will make the decisions on their behalf.
  • Parental Responsibility - All mothers and most fathers automatically receive legal rights and responsibilities as a parent, and this is known as ‘parental responsibility’. Parental responsibility means that parents have the following legal duties: To provide a home and protect and maintain the child and their belongings, disciplining the child, establishing education for the child and agreeing to any required medical treatment that they need. Parents need to financially support their children, whether they have parental responsibility or not.
  • Adoption - Children who cannot be brought up by their biological parents can be adopted, which means that they enter a new and permanent family. To be adopted, a child must be under the age of 18 and not be married or in a civil partnership. Consent from the birth parents is normally required for the adoption to go ahead, unless they cannot be found, they are incapable of giving consent or their consent is deemed as an unsafe pursuit for the child.
