What are intellectual property rights?

The Copyright, Designs and Patent Acts (CPDA) 1998 is the legislation that governs a company's creative value, namely its intellectual property. Intellectual property is often very valuable for a company and can include brand names, product designs, trademarks, new inventions, marketing ideas and copyright. The protective legislation stated in the CPDA serves to secure against the unauthorised usage of these concepts. Ownership of IP rights is defined in the CDPA as being the property of the individual who developed or designed the concept that satisfies the patent criteria or anyone who subsequently obtains these rights from the previous owner.

What does Copyright Mean?

Copyright is a legal attainment that may be given to individuals or companies after the development or financial investment into certain products or work. The Copyright, Designs and Patent Act (CDPA) 1998 sets out the laws that governs this area and outlines the conditions that need to be met to achieve protection. The CPDA outlines that protection can only be issued for work that falls into one of the following categories: literature, published editions or broadcasts, dramatic or musical work, films produced post 1957 and sound recordings or cable programmes made after 1st January 1985. International agreements are established that mean the creators of work do not need to apply for protection as it would be granted automatically. There are a number of copyright durations for various work types, with literary, musical, dramatic or artistic work lasting 70 years from the death of the author or creator. Sound recordings and broadcasts have protection that lasts for a duration of 50 years from the end of the year in which is was created or first broadcast respectively. The copyright protection time period for films is 70 years from the end of the year in which the last director, musical creator or creator of screenplay dies. A violation of copyright laws is a criminal offence and court proceedings could be brought against an offending person or company.

Patents

Patents are intellectual property rights that are provided by the government to inventors and they last for a set amount of time. A patent will have to be applied for because it is not granted automatically like copyright protection. The Intellectual Property Office is responsible for the receipt and processing of formal applications for patents. Patent awarded inventions are protected by British civil law from the unauthorised sale, use or distribution of products. Patents will only be given when the following criteria are satisfied:

  • The concept needs to be a unique one and the invention must not be obvious to those currently working in the field.
  • The invention should be practically viable within its intended industry and so most creative concepts are not patent protected.
  • The patent protected product is owned by the inventor or the inventor’s employer in more complex situations. Following the application, a patent normally will take between 3 and 5 years to obtain and it will last for as long as the owner pays the yearly renewal cost. If ever the renewal fee is not paid, the protection on the invention will end.

    What are Trademarks?

    Traditionally, trademarks were logos or words that represented the origin of a product. Presently, trademark laws function to protect a wider range of concepts. In order for a trademark to be approved, it has to be verified that the thing that you are trying to protect is different from those of other businesses. If a trademark consists of anything other than a logo or words, it must be graphically representable. The IPO are in charge of the receipt and management of trademark applications and will demand evidence from applicants of the originality of their brand. Authorised trademarks will last for 10 years and businesses have the option to renew their trademark through application and fee payment to the IPO.
