The MCA allows for people to make future plans regarding ways in which decisions will be made on their behalf should they lack mental capacity in the future through the appointment of a trusted person. The MCA explains that whenever possible, individuals who lack mental capacity should be supported and encouraged to make their own decisions. The MCA stipulates that all decisions made on behalf of a person that lacks mental capacity be done so with their best interests in mind.

Advance Decision to Refuse Treatment

An advance decision to refuse treatment is sometimes known as a living will or an ADRT and refers to a person’s decision to refuse specific kinds of medical care at some point in the future. This allows people an opportunity to establish their wishes to refuse certain types of treatment in advance just in case they cannot communicate this at a later date to their relatives, carers or medical staff. The advance decision should lay out the particular treatments and types of conditions in which they should be refused or accepted. Life-sustaining treatments, those which are used to potentially save your life, can be refused if they arecontained in the advance decision. An advance decision will be valid so long as it was created when the individual had the mental capacity to make such choices. The advance decision contents should be communicated to relatives and carers, and a copy need to be saved on your medical records.
