The Mental Health Act 1983

In order to carry out the rules specified by the Mental Health Act, approved professionals should be used in assessments and admittance to guarantee the fairness and regulation of the legislation.

The Mental Capacity Act 2005

To offer protection and empowerment to people who lack mental capacity to make their own decisions, the Mental Health Capacity Act (MCA) was established. This law is applicable to people over the age of 16. The MCA also allows individuals to appoint a trusted individual who may make such decisions on their behalf if they lose the mental capacity to do so in the future. As outlined in the MCA, individuals who lack mental capacity should be provided the chance to make their own decisions with the support of any available help. The MCA also sets out the importance of keeping the best interests of the person who lacks mental capacity in your mind when making decisions on their behalf.

Living Wills

An advance decision allows people to refuse specific types of medical attention in the future if they want to and is also known as a living will or an ADRT. This means that a person can communicate their desire to refuse specific treatments in advance in the event they are incapable of communicate this to family, carers or medical professionals at a later time. The document needs to be specific and communicate the specific treatments which are to be refused as well as the situations in which they should not be given. Life-sustaining treatments, those that are utilized to potentially save your life, could be refused if they arecontained in the advance decision. Advance decisions can be created by any adult who has the mental capacity to make such choices. The advance decision contents needs to be communicated to relatives and carers, and a copy should be saved on your medical records.
