Why Hire a Bacup Mental Health Law Solicitor?

There are a variety of laws that help to determine the ways by which treatment and care can be provided to individuals that have problems with mental illness. Here are some of the key laws and principles of mental health law:

The Mental Health Act 1983

The Mental health Act was established in 1983 and sets out the laws surrounding the treatment, care and interactions with those affected by a mental illness. The act explains the ways in which a person with a ‘mental disorder’ can be detained, admitted to hospital and treated without their prior consent. This is done so for the protection of the individual and for the wider community. The Mental Health Act also sets out the authority to place patients on to Community Treatment Orders (CTOs) after they have completed a period of compulsory treatment in hospital. Approved professionals are used to assess and establish treatment needs to be certain that patients are reviewed fairly and in a regulatory manner, as established under the Mental Health Act.

The Mental Capacity Act 2005

The Mental Capacity Act (MCA) was designed to offer protection and empower those who lack the mental capacity to make their own decisions regarding their care and treatment. The law is applicable to those aged 16 and above. The MCA allows for people to make future plans regarding the ways in which decisions will be made on their behalf if they lack mental capacity in the future through the appointment of a trusted person. As outlined in the MCA, individuals who lack mental capacity should be provided the chance to make their own decisions with the support of any available help. The MCA stipulates that all decisions made on behalf of an individual who lacks mental capacity be done so with their best interests in mind.

Making a Living Will

An advance decision to refuse treatment is also known as a living will or an ADRT and refers to a person’s decision to refuse specific types of medical care at some point in the future. This means that if somebody cannot communicate their preferences to refuse certain treatments in the future, their wishes can be communicated to family, carers and health professionals in advance. The advance decision should set out the particular treatments and types of conditions in which they should be refused or accepted. The advance decision can also communicate your wish to refuse treatment that could potentially help to keep you alive, known as life-sustaining treatments. As long as you have the mental capacity to make such choices, you are entitled to create a valid advance decision. A copy of the advance decision should be saved on your medical records as well as being communicated to family and care workers.
