What does Mental Health Law cover?

The Mental Health Act 1983

The Mental health Act was established in 1983 and sets out the laws about the treatment, care and interactions with those suffering with a mental illness. The act contains the laws which allow anyone with a ‘mental disorder’ to be detained, admitted to hospital and treated without their consent. In some circumstances, such action is needed in an effort to protect the individual and also the community. The Mental Health Act also sets out the authority to place patients on to Community Treatment Orders (CTOs) after they have completed a period of compulsory treatment in hospital. As per the contents of the Mental Health Act, only approved professionals can authorise the admittance and treatment of a patient in an effort to maximise the fairness and regulatory observations of such actions.

The Mental Capacity Act 2005

The Mental Capacity Act (MCA) serves to provide empowerment and protection to people who lack mental capacity which inhibits their ability to make decisions for themselves. The law is in place to cover individuals older than 16. The MCA allows for people to make future plans regarding the ways in which decisions will be made for them should they lack mental capacity in the future through the appointment of a trusted person. As outlined in the MCA, individuals who lack mental capacity should be provided the chance to make their own decisions with the support of any available help. The MCA also sets out the importance of keeping the best interests of the person who lacks mental capacity as the primary goal when making decisions on their behalf.

Living Wills

An advance decision allows individuals the chance to document their wishes to refuse specific treatment types in the future and is sometimes called a living will or an ADRT. This allows people an opportunity to set out their desires to refuse certain kinds of treatment in advance just in case they are unable to communicate this at a later date to their relatives, carers or medical staff. Only those treatments which are specifically named in the advance decision will be refused and it is possible to stipulate the precise situations that you would want to refuse them. The advance decision can also include the wish to refuse treatments which could save your life, known as life-sustaining treatments. Advance decisions can be created by any adult who has the mental capacity to make such choices. A copy of the advance decision should be saved on your medical records as well as being communicated to family and care workers.
