What services do Mental Health Solicitors in Burnley Provide?

Mental health is a challenging area of law which affects some of the most vulnerable men and women in society. A few key pieces of legislation in this field of law are described below:

The Mental Health Act 1983

The Mental Health Act 1983 is legislation surrounding the treatment and care of people living with mental illness. The act contains the laws that allow an individual with a ‘mental disorder’ to be detained, admitted to hospital and treated without their consent. This is done so for the protection of the individual and for the wider community. The Mental Health Act also sets out the authority to put patients on to Community Treatment Orders (CTOs) after they have completed a period of compulsory treatment in hospital. As per the contents of the Mental Health Act, only approved professionals can authorise the admittance and treatment of a patient in order to maximise the fairness and regulatory observations of such actions.

The Mental Capacity Act 2005

The Mental Capacity Act (MCA) was introduced to assist those that lack the mental capacity to make their own decisions by providing protection and empowerment to them. All people older than 16 are protected by the act. The MCA allows for people to make future plans regarding the ways in which decisions will be made on their behalf if they lack mental capacity in the future through the appointment of a trusted person. As outlined in the MCA, individuals who lack mental capacity should be provided the chance to make their own decisions with the support of any available help. The MCA stipulates that all decisions made on behalf of someone who lacks mental capacity be done so with their best interests in mind.

Making an Advance Decision to Refuse Medical Treatment

An advance decision to refuse treatment is also known as a living will or an ADRT and concerns a person’s decision to refuse specific types of medical treatment at some stage in the future. This means that if a person cannot communicate their preferences to refuse certain treatments at a later stage, their wishes can be communicated to family, carers and health professionals in advance. The advance decision should establish the exact treatments and types of conditions in which they should be refused or accepted. The advance decision can also include the wish to refuse treatments which could save your life, known as life-sustaining treatments. Advance decisions can be created by any adult who has the mental capacity to make such choices. A copy of the advance decision should be saved in your medical records in addition to being communicated to family and care workers.
