The law is in place to cover individuals over the age of 16. The MCA also allows individuals to appoint a trusted individual who may make such decisions on their behalf if they lose the mental capacity to do so in the future. The MCA outlines the significance of assisting those who lack mental capacity to be engaged and make decisions regarding their care wherever possible. The MCA also stipulates that when a decision is reached on the behalf of another person, it ought to done so with that person’s best interests in mind.

Making an Advance Decision to Refuse Medical Treatment

An advance decision to refuse treatment is also known as a living will or an ADRT and concerns a person’s decision to refuse specific kinds of medical care at some point in the future. This means that if somebody cannot communicate their preferences to refuse certain treatments at a later stage, their wishes can be communicated to family, carers and health professionals in advance. The advance decision should establish the specific treatments and scenarios in which they should be refused or accepted. Life-sustaining treatments, those that are used to potentially save your life, could be refused if they arewithin the advance decision. Any adult with the mental capacity to make such choices is permitted to create an advance decision. A copy of the advance decision should be saved on your medical records as well as being communicated to family and care workers.
