This law applies to people over the age of 16. The MCA sets out that individuals can make provisions regarding their future care if and when they lack mental capacity by appointing a trusted person to make decisions for them. The MCA explains that whenever possible, those who lack mental capacity should be supported and encouraged to make their own decisions. It is also necessary, as per the MCA, for all decisions made on behalf of an individual to be made with their best interests in mind.

Living Wills

An advance decision allows individuals the possibility to document their wishes to refuse specific treatment types in the future and is sometimes called a living will or an ADRT. The advance decision acts as a way to inform relatives, carers and health professionals that you wish to refuse specific treatments in the future and so your wishes will be respected should you be unable to communicate them in the future. Only those treatments that are specifically named in the advance decision can be refused and it is possible to stipulate the particular situations in which you wish to refuse them. The advance decision may also communicate your desire to refuse medical treatment that could potentially keep you alive, identified as life-sustaining treatments. An advance decision will be valid provided that it was created when the individual had the mental capacity to make such choices. A copy of the advance decision should be saved on your medical records as well as being communicated to family and care workers.
