What services do Mental Health Solicitors in Preston Provide?

There are various laws that help to determine the ways by which treatment and care can be provided to individuals that suffer with mental illness. A few key pieces of legislation in this field of law are described below:

The Mental Health Act 1983

The Mental Health Act 1983 offers guidelines on the laws surrounding the treatment and interactions with people impacted by a mental illness. The act confirms the legislation in regards to the non-consensual detainment, hospitalisation and treatment of anyone with a ‘mental disorder’. In certain circumstances, such action is required in an effort to protect the individual and the community. The Mental Health Act also sets the occasions where it could be appropriate to place someone on a Community Treatment Order (CTO) following their hospitalisation. To meet the rules specified by the Mental Health Act, approved professionals must be used in assessments and admittance to ensure the fairness and regulation of the legislation.

The Mental Capacity Act 2005

To offer protection and empowerment to individuals who lack mental capacity to make their own decisions, the Mental Health Capacity Act (MCA) was established. The law is in place to cover individuals older than 16. The MCA encourages individuals to appoint a trusted person who can be relied upon to make decisions about their care and welfare should they lack the mental capacity to do so in the future. As outlined in the MCA, individuals who lack mental capacity should be provided the opportunity to make their own decisions with the support of any available help. It is also necessary, as per the MCA, for all decisions made on behalf of another individual to be made with their best interests in mind.

Advance Decision to Refuse Treatment

Advanced decisions or a living will as they are also known, serve as a means of individuals communicating their desire to refuse specific forms of treatment at some stage in the future if they want to. This means an individual can communicate their desire to refuse specific treatments in advance in case they are unable to communicate this to family, carers or healthcare providers at a later date. The advance decision needs to be specific regarding the treatments and situations in which they should be refused. The advance decision can also contain the wish to refuse treatments which could save your life, known as life-sustaining treatments. So long as you have the mental capacity to make such choices, you are allowed to create a valid advance decision. A copy of the advance decision should be saved in your medical records in addition to being communicated to family and care workers.
