The Mental Health Act 1983

The Mental Capacity Act 2005

The Mental Capacity Act (MCA) was introduced to assist people who lack the mental capacity to make their own decisions by offering protection and empowerment to them. The law is in place to cover individuals over the age of 16. The MCA encourages individuals to appoint a trusted person who can be relied upon to make decisions about their care and welfare should they lack the mental capacity to do so in the future. The act stipulates that people that lack mental capacity should be given the opportunity and support to make decisions themselves where possible. The MCA also stipulates that whenever a decision is reached on the behalf of another person, it must be done so with that person’s interests in mind.

Living Wills

An advance decision allows individuals the possibility to document their wishes to refuse specific treatment types in the future and is sometimes referred to as a living will or an ADRT. This gives people the chance to establish their desires to refuse certain types of treatment in advance in the event they cannot communicate this at a later date to their relatives, carers or medical staff. Only those treatments that are specifically named in the advance decision will be refused and it is possible to stipulate the particular situations in which you would want to refuse them. The advance decision may also communicate your preference to refuse a medical treatment which could potentially help to keep you alive, known as life-sustaining treatments. So long as you possess the mental capacity to make such choices, you are entitled to make a valid advance decision. Family and carers should be informed of the contents of your advance decision as well as a copy being stored on your medical records.
