Do I need a personal injury solicitor?

The first step is to decide if the location of the solicitor is important to you. We always recommend hiring a local solicitor, as this gives you the option of visiting the solicitor in person, and you may benefit from having a solicitor with local knowledge of the area where you have had your accident. You can therefore narrow down your search to solicitors that have an office in your town or county.

Look for a personal injury solicitor that has been accredited by the Law Society or the Association of Personal Injury Lawyers (APIL). A solicitor that has been awarded either of these accreditations has been assessed to ensure they have the highest standards of client care and expertise in personal injury claims. You can identify these personal injury accreditations by looking for quality marks on the solicitor profile page or their website.

Does the solicitor come recommended? Reading what previous clients have said about a solicitor and the experience they had is another great way to choose the right solicitor for you. Most solicitors will be happy to provide you with reviews and recommendations from past clients, so you could also ask a solicitor to provide you with these before deciding whether or not to hire them.

How much will it cost to hire a personal injury lawyer?

Most solicitors will provide you will a free initial consultation. During this consultation, they will assess the circumstances of your accident and the injury you have suffered, to determine if they can help you make a claim. The consultation is also an opportunity for you to assess the solicitor, so don't be afraid to ask questions and raise any concerns you may have.

During your consultation, the solicitor will let you know how much they will charge for their service. Most personal injury solicitors will be able to offer you a conditional fee agreement (CFA), which are more commonly referred to as a 'no win no fee' service. This enables a solicitor to take on your accident claim without any upfront cost to you. You will only pay a fee if your compensation claim is successful, and this fee will be deducted from the amount of compensation you are awarded. This is known as a "success fee", with the maximum amount being 25% of your compensation. The success fee solicitors charge will vary, so it is important that you discuss this before hiring a personal injury solicitor.

Did you know? Did you know? Before 1st April 2013, personal injury solicitors were often able to offer claimants a 100% compensation guarantee. If the claim was successful, solicitors were able to recover their costs from the third party at fault for the accident. However, changes to the law mean that since 1st April 2013, solicitors can no longer recover these costs from the losing defendant, and must recover these as a deduction from the compensation awarded. These changes were recommended in The Review of Civil Litigation Costs, referred to as the Jackson Report, which was a review carried out by Lord Justice Jackson. The recommendations made in the Jackson Report regarding conditional fee agreements were subsequently enacted in the Legal Aid, Sentencing and Punishment of Offenders Act 2012 which came into force on 1st April 2013.

What questions should I ask before hiring a personal injury solicitor?

Before hiring a solicitor for your accident claim, you should always make sure you ask plenty of questions in order to be confident that you are choosing the right injury solicitor for you. Here are some of the questions we would recommend you ask:

  • Will the solicitor work on a no win no fee basis?
  • If my claim is successful, what percentage of the compensation will the solicitor take as their success fee?
  • Has the solicitor worked on similar claims before? What was the outcome of these claims?
  • How will I be kept updated with the progress of my claim? 
  • How long is the claim likely to take?
  • Does the solicitor have any personal injury accreditations?

We always recommend contacting at least 2 or 3 solicitors before you decide which solicitor to instruct for your accident claim. By doing some research and asking the above questions, you can then compare what each solicitor has to offer and how much they will cost before making your final decision. It is important that you feel comfortable communicating with your solicitor, and feel confident that they will provide you will a high standard of service.
