What is professional negligence?

Professional negligence occurs when a professional, from any industry, fails to complete their responsibilities to the required standard. A professional is someone who has an expertise and skill level which is high for the services that they offer and as such, can be trusted in their abilities. Professional negligence claims can be made by a person who can demonstrate that the duty of care owed to them by the professional was breached and that this breach resulted in a loss to them.

Do I have a claim for professional negligence?

Proof must be submitted with a professional negligence claim in order for the claimant to be successful in the case. The submitted proof must show that the service levels received from the professional were of a lower than acceptable standard for the industry. The normal standards of the industry will be assessed in order to determine whether there was a shortfall between expected levels and those received. The claimant will need to give information regarding what promises the professional made, the fees charged, the work provided and the results of the services given. Upon receipt of this information, judgements can be made as to the eligibility of the claim and the extent of loss suffered by the claimant and compensation negotiations will commence.

What is the time limit for making a claim?

The usual time limit for starting a professional negligence claim is six years from the date of the negligent act. Where it is deemed that the negligence was not immediately obvious, a court can use their discretion to extend the time limit if they think this is appropriate. In order to maximise eligibility the solicitor will encourage their client to initiate their claim as soon as possible. The professional negligence solicitor will also guide their client on how to proceed in order to minimise delays and reach a favourable outcome as quickly as possible. This may include following the ‘Professional Negligence Pre-Action Protocol', which means that all parties share information openly in order to save time and costs and aim to reach settlement out of court.

Will I need to go to court?

If the process of the Professional Negligence Pre-Action Protocol does not lead to an agreeable out of court settlement, court proceedings will need to commence. Following the initiation of the court proceedings, it takes around a year to reach the date of a court hearing. Cases that result in a court trial will usually require evidence to be heard in court from the claimant, the defendant and any witnesses. The solicitor will strive to reach an out of court settlement, and this is successful in the majority of cases.
