Will I need to go to court?

If the process of the Professional Negligence Pre-Action Protocol does not lead to an agreeable out of court settlement, court proceedings will need to commence. Following the initiation of the court proceedings, it takes around a year to reach the date of a court hearing. Cases that result in a court trial will usually require evidence to be heard in court from the claimant, the defendant and any witnesses. The solicitor will strive to reach an out of court settlement, and this is successful in the majority of cases.
