Having a valid will which represents your wishes and offers financial stability for your family is certainly an aspiration for many of us. Although there may be DIY options available for writing a will, hiring an experienced and reputable Hull solicitor will make sure your will is legally valid and fully meets your wishes.

What is a will?

A will is a legal document which enables an individual to communicate their wishes regarding the distribution of their assets and the care of any children following their death. Wills should be made in writing and signed by yourself and your witnesses to ensure that they are legally recognised. The estates of people who die without having made a will are divided as per the law and not always in accordance with the wishes of the person.

Types of will

Dependent upon a person’s needs, there are a number of different wills that can be used. Some of the most common include:

  • A single will is sometimes known as a testamentary will and is the most traditional type of will. The single will is formally created and signed in front of witnesses.
  • The option is available for couples to write a mirror will which enables them to create almost identical wills, leaving their assets to the same beneficiaries, usually each other in the first place.
  • Living wills are not concerned with the distribution of assets and instead serve to enable individuals to lay out their preferences concerning certain treatments that they want to decline if they do not have the mental capacity to communicate this will at a later date.

What is Probate?

Probate is the legal and financial processes that are followed to deal with the assets and property of a deceased individual in England and Wales. Probate involves a range of required tasks which includes the identification of a deceased person’s property, payment of taxes, management of the accounts of the estate and distribution of net assets.

What is a trust?

Trusts are used to manage the assets of an individual, including their property, money and investments. There are different types of trusts available, each having their particular tax considerations. There are a variety of roles that must be filled for a trust:

  • A settlor’ who is the individual that puts their assets into a trust
  • A ‘trustee’ who is accountable for managing the trust
  • A ‘beneficiary’ who obtains the benefit of the trust

Trusts are used for a number of reasons including to protect a family’s assets, manage the assets of a child or incapacitated person or to distribute assets during the settlor’s life or when they die. A Hull solicitor will help their clients to recognise the need for a trust and to create the trust in a legal way, reflective of the settlor’s wishes.
