A: 'Your civil claim does not necessarily help your visa application ( you did not state the basis of your FLR application or the current visa you hold).If the claim has nothing to do with your FLR application, then it is advisable not to mention it)

Q: I have also made Home Office as the second party in my writ petition which I an planning to submit soon. Is that a good idea?

I am afraid the Home Office may react to it negatively so I shouldn't mention them at all in the writ. However, I m also thinking the initial receipt produced by the Sheriff's court and the judge's initial standard order may assist'.

A: Your FLR application will be treated on its own merit. Your civil claim will not have any impact on their decision, whether positive or negative.

Q: 'In your perspective, is the Home Office going to give the above any credence or should I not mention them at all in the initial writ?'

A: Unfortunately, I am unable to answer this question because I do not know why the Home Office is being included in the first place.

A court hearing against my current visa sponsor. How is the UKVI going to consider this if I mention it in my FLR application?

The time will run from the date you can be considered to have been a qualified person and were resident in the UK. This will differ depending on your circumstances. Although the time would certainly run from the date of issue of your resident card it could be earlier and in most cases will be. In order to confirm the exact date I would need to have additional information but it will be somewhere between the date of you entering the UK and the date your resident card was issued.
