Good afternoon.

It is difficult to give you full advice without knowing the whole circumstances. However, on the basis of the information provided I would advise as follows:

The law does not allow people to benefit from crimes so the starting point is that you cannot claim compensation if involved as a driver or passenger in a car that was stolen. HOWEVER, there is an exception to this and it is where the passenger:

(a) did not know and had no reason to believe that the vehicle had been stolen or unlawfully taken until after the commencement of his journey, and 

(b) could not reasonably have been expected to have alighted from the vehicle.

In other words, if you can prove that you did not know the car was stolen until after you had entered the car, and there was no opportunity for you to get out of the car before the accident occurred, they you should be able to claim compensation from the insurers of the vehicle. I would say that the insurers would probably fight a claim so you would have to be prepared for the fact that the case might well proceed as far as County Court.
