I have specified in my will that I want my executor to scatter my ashes in my back garden. If my husband is alive he would do this but if not and I make a firm of solicitors my executor then will they do it?

    Very interesting question!

    Here is your answer:

Technically no. On death, the Executor will have custody of any remains and are responsible for funeral arrangements. They are not required to follow any wishes expressed in the will although it would be unusual for them not to. In practice, the funeral is normally arranged by someone who accepts the task. If you think your executor may not follow your wishes you may want to think about making your wishes known to other family or friends s who could endeavour to carry them out.
